Meeting with the FAA of the State Chief Information Commissioner on 15.2.24 at 1 pm for hearing against the illegal direction dt. 20.10.23 by ALL INFORMATION COMMISSIONERS.

We were 11 members who attended the hearing who are active members of Petition Group Foundation.

We also acknowledge the support from Shri Hemant khandekar and Rajeshwari Melville of

Shivsena Maharashtra Rajya Gruh Sankul Samanvayak Shree Hemant Khandekar from Balasaheb Bhawan

I had challenged this direction on the grounds that No Information Commissioners have legal authority to issue such directions and the same was confirmed by HON. Bombay High Court.

The Hon COURT had earlier quashed a direction on the grounds that Information Commissioners have no legal authority to issue direction which amounts to subordinate legislation i.e. making of laws.

The Hon COURT also recorded that the Information Commissioners shall look into the difficulties of citizens and use the time in increasing the efficiency of the Information Commission.

Inspite of the above clear direction the Information Commissioners wrongfully issued direction that video recording shall not be permitted.

In the above circumstances, I requested the FAA to first pass written order whether

  1. Information commissioner is subordinate to BOMBAY HIGH COURT or not
  2. Whether orders by HON. Bombay High Court is binding on Information Commissioners
  3. Whether section 2 h, 2 j, 4, 7(1), 7(8)(I), 8, 19(5) RTI act is binding on INFORMATION COMMISSIONERS.

FAA admitted that information commissioner is subordinate and order of Bombay High court is binding.

So now notings will be presented by FAA and PIO to all INFORMATION COMMISSIONERS to revoke the direction banning video recording and for strict implementation of the above RTI sections.

This change will reduce the appeals and save the tax payers resources

We thank Smt Savita Jawale and Smt Shilpa Deshmukh for giving patient hearing and understanding the difficulties of citizens and for assurance to represent the matter .

It’s a great victory for citizens and RTI .
