Calling for investigation on Festival day for filing complaint of failure to discharge duty by BMC officers.

It is informed that the police called respondent for statement and left for bandobast.

It is therefore totally incorrect to cause harassment to citizens by making them wait, that it will be impossible to record a statement in length, very well knowing the heavy schedule and bandobast duties.

The police shall provide copy of FIR to the accused and give sufficient time to prepare and collect evidence he wishes to submit.

The CCTV footage relied upon to come to conclusion to make such serious allegations. And mandatory registers maintained to prove that the complainant has discharged her duty and there is no failure to discharge duty.

Calling the respondents for recording of statement without giving proper opportunity is denial and violation of principles of natural justice.

Police shall investigate if the COMPLAINANT have fixed board outside cabin and the register disclosing the details of the citizens she has met as per

A. circular 7.1.2000 which is still in force every Monday and Friday between 3 pm to 5 pm without prior appointment

B. GR 13.1.25 if the complainant met citizens every day without prior appointment on fixed timings.

Police will investigate whether the BMC officers have implemented these circulars before calling the alert citizen.

Article 51 A of the Constitution empowers every citizen to file complaint against public servant who fail to discharge the duty or commit frauds causing wrongful loss to the public authority or against the interest of the public at large.

Hence, it is the duty of the police officer to first verify whether the complainant who is the public servant has discharge the duty and complied with the mandatory circulars and GRS directed by the confident authority.

In the event, if these directions of law has not been compiled in that event, it is the public servant who should be prosecuted for failure to discharge duty and their why causing announce prejudice injury to the public at large.

Request to take action in the matters of fraud against the state as mentioned above with priority instead of creating threat in minds of alert citizens who expose fraud.

If at all the complaint is filed by a citizen it is the duty of the public servant to dispose of the complaint within 45 days as required under regulation 10 of Delay in discharge of duty act with evidences of compliance however in this case it appears that no such compliance or disposal of grievances have been carried out before finding or registration of FIR

Please educate me if my submission is incorrect with section, provision of law and materials relied upon to register FIR without collecting the evidences.
